Air Oasis Mobile Message Service Terms and Conditions

The Air Oasis mobile message service (powered by Message Media) is operated by Air Oasis (the “Company”, “We”, “Our”, or “Us”). By opting-in or using the Air Oasis mobile message service (the “Service”), you accept these terms and conditions (“Mobile Terms”), agree to resolve any dispute with Air Oasis through binding arbitration, and you waive any right to participate in class actions.

We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

Air Oasis’s Mobile Messaging Service includes any arrangement or situation in which Air Oasis sends one or more text messages to you. Opting in means that you have requested, joined, agreed to, enrolled in, signed up for, acknowledged or otherwise consented to receive one or more text messages from Air Oasis through your wireless provider to the mobile number you provided. 

If you have opted in, the Service provides order updates, account alerts, promotional messages: promotions, specials, person to person, and other marketing offers (e.g., cart reminders) from Air Oasis.Text messages may be sent to the cell phone number associated with your account using an automatic messaging platform (autodialer), by a user, or by other automated or manual technology. You hereby explicitly authorize Air Oasis to include marketing content in any such message. Your consent to receive marketing text messages is not required as a condition of purchasing any products or services. 

Message frequency varies, but averages three to five text messages per month. You can cancel or opt-out at any time by texting the single keyword command “STOP” to (806-373-7788). You’ll receive a one-time opt-out confirmation text message. If you have subscribed to other Air Oasis mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. Air Oasis does not charge for this Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

We may change any short code or telephone number we use to operate the Service at any time and may or may not notify you of these changes. You acknowledge that any messages, including any STOP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

Neither Air Oasis nor the wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages. If at any time you intend to stop using the mobile telephone number that has been used to subscribe to the Program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the User Opt Out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a material part of these terms and conditions.

To the extent permitted by applicable law, you agree that Air Oasis shall not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.You agree that, in the event any dispute or claim arises out of these Mobile Terms or relating to your use of the Mobile Services that you and Company will attempt in good faith to negotiate a written resolution of the matter directly between the parties. You agree that if the matter remains unsettled for forty-five (45) days after notification (via certified mail or personal delivery) that a dispute exists, the dispute shall be resolved by final and binding arbitration in Randall County, Texas under the rules of the American Arbitration Association then in effect. Should you file any arbitration claims, administrative or legal actions without first having attempted to resolve the matter by mediation, then you will not be entitled to recover attorney’s fees, even if you would otherwise be entitled to them.

THE PARTIES HEREBY IRREVOCABLY WAIVE ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE MOBILE TERMS. IN ADDITION, YOU HEREBY AGREE THAT ANY DISPUTES RELATED TO YOUR USE OF OUR SERVICES SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.

The laws applicable to the interpretation of these Mobile Terms shall be the laws of the State of Texas, and applicable federal law, without regard to any conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Randall County, Texas.
